THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION.
Workway Nursing, and its’ employees are required by law to maintain the privacy of health information and to provide notice of its legal duties and privacy practices with respect to health information.
Workway Nursing is required to follow the privacy practices described in this Notice. This Notice describes how it has extended certain protections to the protected health information (PHI) of its employees and how, when, and why we may use and disclosure PHI. With certain exceptions, Workway Nursing, will use or disclose your PHI in the minimum necessary manner to accomplish the intended purpose of the use or disclosure. Workway Nursing will share PHI as is necessary to provide quality health care and healthcare services to its clients.
We reserve the right to change our privacy practices and the terms of this Notice at any time. If we change our notice, we will post the revised notice on our website, at all staffing offices, and will have them available upon request. You can receive a copy of the current notice at any time. The effective date is listed just below the title. You may be asked to acknowledge in writing your receipt of this notice. Uses and Disclosures of Protected Health Information at our Client’s Facilities
Workway Nursing is committed to maintaining the confidentiality of health information of our client’s patients. Our firm employs professionals who perform healthcare services at our client’s facilities and come in contact and receive PHI in the normal course of their duties. This health information may be used and disclosed to other healthcare professionals at the client’s facility for purposes of treatment and health care operations. Outside of these permitted uses, Workway Nursing employees will not disclose health information unless the law permits or requires them to use or disclose this information. Employees who violate these restrictions are subject to disciplinary action, including termination of employment and civil and criminal prosecution.
Uses and Disclosures of Protected Health Information of our Clinical Employees
Workway Nursing is committed to maintaining the confidentiality of health information of our Clinical Employees. Our firm employs professionals who perform healthcare services at our client’s facilities and our employee’s health is a matter of patient and employee safety. Workway Nursing provides our employee’s health information or may attest to the status of said health information at the request of our client. Workway Nursing will only provide the health information requested by the client and only for the purposes of insuring a safe work environment and health care operations. Outside of these permitted uses, Workway Nursing employees will not disclose health information unless the law permits or requires them to use or disclose this information.
Uses and Disclosures of PMI of Clinical Employees
We may use or disclose medical information of our Clinical Employees without their prior authorization for several other reasons. Subject to certain requirements, we may give out medical information about them without prior authorization for public health purposes, accrediting organizations such as JCAHO, required abuse or neglect reporting, health oversight audits or inspections, worker’s compensation purposes, and emergencies. We also disclose medical information when required by law, such as in response to a request from law enforcement in specific circumstances or in response to valid judicial or administrative orders.
Our Employee’s Rights Regarding their Health Information
1. Restrictions on Use and Disclosure of Individual Health Information. Our Employees have the right to request that we restrict how we use and disclosure their health information. These restrictions must be made in writing and signed by them or their legal representative. Workway Nursing is not required to agree to their restrictions. We cannot agree to limit uses/disclosures that are required by law. In the event of a termination of an agreed-to restriction by us, we will notify them of such termination. They may terminate, in writing or orally, any agreed to restriction by sending such termination notice to the Workway Nursing Staffing office.
2. Access and/or Copying of Employee’s Health Information. Workway Nursing employees have the right to request or inspect and/or copy their health information. The request must be in writing to the Staffing Coordinator or Custodian of Records. If an employee requests copies, we may charge a fee for the cost of copying, or if it was for a medical procedure which was paid for by the Company, the cost of the procedure, mailing or other related supplies. There will also be a charge for postage if the request is for a mailed copy and, if requested, for preparation of a summary of the requested information. We will respond within 30 days unless an extension is taken. In certain circumstances, access may not be permitted. Depending on the circumstances, a review of the decision to deny access may be requested. If we deny the request, a written notice will be given that will explain the basis for the decision and the right to appeal.
3. Accounting for Disclosures of Individual Health Information. Our employees have the right to receive an accounting of certain disclosures of health information made by us. Requests must be made in writing and signed by the requesting employee or their representative. Requests for Accounting of Disclosures may be made to the Custodian of Records. The first accounting in any 12-month period is free; a fee will be charged for each subsequent accounting within the same twelve-month period.
4. Right to Paper Copy. Employees have the right to receive a paper copy of this or any revised Notice and/or an electronic copy by email upon request to Custodian of Records.
5. Confidential Communications. Medical information about our employees will be communicated ONLY in a confidential manner, such as sending mail to a specific individual at a corporate address, a home address, or directly to a private fax or email service. How to Complain About Our Privacy Practices
Employees, clients, or patients of our employees who believe their privacy rights have been violated, or you disagree with a decision about your PHI, you may file a complaint with the Custodian of Records, at the following address:

Workway Nursing Patient Healthcare Information Privacy Policy
Workway Nursing employs licensed professionals, who treat patients at our client’s facilities in which health care services are provided. They may share personal health information concerning their patients to carry out treatment and health care operations as permitted by law.
